OnomonoMEDIA LLC (“Company”) processes personal information in accordance with applicable legislation and its privacy policy. OMDigital will process the personal data covered by this agreement, consisting of email addresses, photos and videos in accordance and to the extent of this agreement. The legal basis for the processing is the fulfilment of the terms and commitments of this agreement.

This policy regarding our privacy practices (the “Privacy Policy”) describes how we handle the information we collect when you visit and use OM Digital products and services, together the (“Services”), each as provided by the Company:

  • The Company website available at omdigital.com (the “Website”)
  • The OM Digital camera platform (“OM Digital”)
  • The OM Digital content hosting system (“OM Social”)

When you use the Services, you are consenting to the collection, transfer, storage, disclosure, and other uses of your information as described in this Privacy Policy. Please read it carefully.

1. ABOUT THE PRIVACY POLICY

This Privacy Policy covers our treatment of information gathered when you are using or accessing the Services. This Privacy Policy also covers our treatment of any information that our client shares with us or that we share with our client. This Privacy Policy does not apply to the practices of third parties that Company does not own or control, including but not limited to any third party domains, websites, services and applications (“Third Party Services”) that you elect to access through the Services, or to individuals that we don’t manage or employ.

2. INFORMATION COLLECTION AND USE

A. Personal information

When you use the Services, you may elect to provide public information such as your name and image, in addition to private information such as your email address, phone number, zip code and gender. We do not expose your private information to the public or third parties except in the limited circumstances set forth in this Privacy Policy.

B. Phone and email communications

As part of the Services, you may elect to provide your phone number or email address and receive communications from us, in some cases through our third party service providers. We may also share your phone number or email address with the client who obtained the OM Digital Services for your use and who may use it for client’s own independent purposes in accordance with their own independent privacy practices, including to send marketing communications. Please see the Privacy Policy of the client for details about how it uses your information and to opt out of receiving certain communication from them.

C. Digital image content

By default, all sharing through the Services is public, and when you elect to upload content, it is published so that the public can view it. Once content is published, it can be shared publicly and made accessible to everyone (including search engines) and you may lose any privacy rights you might have regarding that content.

D. Log Data

Similar to many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, and other statistics. In addition, we may use third party services such as Google Analytics and Mixpanel, that collect, monitor and analyze this data. When you use a social media feature within the site, and you post to social media platforms, the social media site will provide us with some information about you.

E. Marketing Communications

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information which is voluntarily provided during the use of this Site.

F. Cookies

Cookies are files with small amounts of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. A. Information shared with the public through the services

As noted above, by default, content published through the Services is available to the public, and this is an important feature of the Services. Such information includes, but is not limited to, anything you choose to publish, including your image, any information that may describe you and anything apparent in a posted OM Digital image. Because this kind of information can be seen by anyone and may be indexed by search engines, you should be careful in what you choose to disclose publicly and make sure it is information that you want to share with everyone.

B. Information shared with third party service providers

We may share your personal information with third-party service providers who need and use such information solely for the purposes of providing services to us to enable us to provide OM Digital Services to you, including, for example, hosting services and messaging services.

C. Information shared with clients

As noted above, if you elect to provide your email address and other personal information to the OM Digital this information may be shared with the client who obtained OM Digital Services for your use.

4. INTERNATIONAL TRANSFER OF INFORMATION

If you are located outside the United States, the information that we collect from you may be transferred to, and stored and processed at, a destination in the United States. By submitting information, you agree to this transfer, storing or processing.

5. DATA RETENTION AND YOUR RIGHTS

We retain personal information as long as necessary to provide the Services to you, to host your content, to contact you about the Services, or as otherwise needed to operate our business and comply with our legal obligations. When you elect to provide your contact information, we may continue to communicate with you about our Services, and let you know about products and services that may interest you, unless you have opted out of receiving marketing communications.

OM Digital respects your rights and intentions regarding use of your private data. You can request to review, update, modify or delete the data we hold about you. We endeavor to protect the security and integrity of information we collect to ensure it is kept private; however we cannot guarantee the security of any information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of your information at any time.

7. CHILDREN’S PRIVACY

The services are intended for users who are 13 years old or older. We do not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently received personal information from a child under the age of 13, we will delete such information from our records.
